The San Francisco Ethics Commission has set a June 19th date for the start of its official misconduct hearing against Sheriff Ross Mirkarimi. In an hours long hearing last night the Commission voted to decide the case based on a preponderance of the evidence rather than the stricter standard of beyond a reasonable doubt. Its recommendation will be based on a majority vote, rather than a unanimous vote as Mirkarimi had wanted, and it will allow some hearsay evidence. Mirkarimi and his wife Eliana Lopez both are expected to testify. Ultimately, the Commission's recommendation will go to the San Francisco Board of Supervisors, which will decide whether Mirkarimi should be permanently removed from office.
